Terms and Conditions – Naj Global Logistics

Welcome to Naj Global Logistics. These Terms and Conditions govern the use of our shipping and logistics services. By engaging our services, you acknowledge that you have read, understood, and agreed to be bound by the terms outlined below. These Terms and Conditions are intended to create a clear understanding between Naj Global Logistics (“the Company”) and our valued customers regarding rights, responsibilities, and limitations associated with the services we provide.

1.Services Provided

Naj Global Logistics offers shipping, freight forwarding, customs clearance assistance, and related logistics support. Our company aims to ensure that goods are transported securely and efficiently. While we strive to provide reliable and timely services, customers understand and accept that transportation schedules and delivery times are estimates only. Circumstances such as weather delays, customs inspections, strikes, equipment malfunctions, or other unforeseen events beyond our control may affect transit times. Naj Global Logistics shall not be held responsible for such delays, but we will make every effort to communicate updates to our customers in a timely manner.

2.Customer Responsibilities

Customers are required to provide accurate, truthful, and complete information when booking or shipping through Naj Global Logistics. This includes correct names, addresses, telephone numbers, and detailed package contents. Any misrepresentation or failure to disclose necessary information may result in delays, additional charges, or refusal of service. Customers are strictly prohibited from shipping illegal items, hazardous goods, or restricted commodities as defined under Jamaican law and international shipping regulations. The customer assumes full responsibility for ensuring that all shipments comply with applicable laws and regulations. Naj Global Logistics reserves the right to refuse any package that violates these requirements.

3.Rates, Fees, and Payments

Naj Global Logistics operates on a pay-upon-arrival system. Customers are not required to make payment before goods are shipped from the origin country. Instead, all charges become due once the shipment has arrived in Jamaica, successfully cleared customs, and is ready for release to the customer.

The total amount due will include:

  1. Customs Duties and Taxes – Any fees, tariffs, or taxes imposed by Jamaican customs or other regulatory authorities.

  2. Naj Global Logistics Service Fees – The shipping and handling charges agreed upon with the customer.

Customers must pay both the customs charges (as assessed by authorities) and Naj Global Logistics’ rate before the goods are released. Payment is expected promptly upon notification that the shipment is available for collection or delivery. Failure to pay within the required time may result in storage fees, additional handling charges, or retention of goods until full payment is received.

Naj Global Logistics does not have control over customs assessments or the amounts charged by Jamaican authorities. Customers accept full responsibility for all such charges, and the Company will not release any shipment until all outstanding amounts have been settled in full.

4.Delivery and Transit Times

Naj Global Logistics provides estimated delivery times based on information available at the time of booking. These estimates are intended to serve as guidelines only and are not guaranteed. The Company will not be liable for any direct or indirect loss resulting from late delivery caused by events beyond our control, including but not limited to adverse weather, natural disasters, customs delays, or carrier disruptions. Customers are encouraged to plan shipments in advance and allow additional time where possible. We commit to keeping customers informed of any significant delays or changes to delivery schedules.

5.Claims Process, and Limitation

Customers may file a claim for lost, damaged, or missing items from their packages if the shipment is insurable and the customer has not opted out of the insurance program. Claims must be filed in accordance with the following procedures:

  1. Claim Filing Period: Claims for packages received by Naj Global Logistics but not yet forwarded to the home country must be filed within thirty (30) days of the shipment’s arrival notification. Claims filed after this period may be denied.

  2. Documentation: To file a claim, the customer must provide all relevant documentation, including but not limited to:

    • A copy of the shipping invoice or receipt

    • A description of the lost or damaged items

    • Photographic evidence of damage (if applicable)

  3. Limitations on Liability:

    • Packages shipped without a valid invoice will be eligible for compensation up to a maximum value of USD 100.

    • Naj Global Logistics does not assume responsibility for losses beyond the declared or documented value of the shipment.

    • Packages that are not insured or for which the customer opted out of insurance are not eligible for claims.

  4. Processing of Claims:

    • Upon receipt of a valid claim, Naj Global Logistics will review the documentation and respond within 7–14 business days.

    • Approved claims will be processed according to the insurance coverage or declared value limits, as applicable.

    • Naj Global Logistics may cooperate with insurance providers and carriers to facilitate claim resolution, but final compensation is subject to insurance policy terms.

  5. Exclusions: Claims will not be accepted for:

    • Normal wear and tear or minor cosmetic damage

    • Delays caused by customs, regulatory authorities, strikes, or natural disasters

    • Items prohibited or restricted under Jamaican law or international shipping regulations

    • Shipments that have not been properly documented or declared

  6. Customer Responsibility: Customers are strongly encouraged to obtain adequate insurance coverage for all valuable or fragile shipments. By using Naj Global Logistics, customers acknowledge that they bear full responsibility for ensuring proper coverage and protection of their goods, and that Naj Global Logistics does not provide insurance or assume liability beyond the limits outlined in this section

6.Customs and Regulatory Compliance

All shipments are subject to inspection by customs and regulatory authorities both in Jamaica and at the destination country. Customers are fully responsible for ensuring that their goods meet the import and export requirements of the relevant jurisdictions. Naj Global Logistics may assist with customs clearance by providing guidance and documentation support; however, ultimate responsibility lies with the customer. Any fines, penalties, or additional charges arising from inaccurate documentation or undeclared goods shall be borne solely by the customer.

7.Limitation of Liability

Naj Global Logistics shall not, under any circumstances, be held liable for indirect, incidental, or consequential damages, including loss of income, business opportunities, or profits arising out of the use of our services. Our liability, if any, shall be limited to the lesser of the declared value of the goods shipped or the actual amount paid for the shipping service. Customers acknowledge that certain risks are inherent in international and domestic transportation, and Naj Global Logistics cannot guarantee complete protection against all unforeseen events.

8.Termination of Services

Naj Global Logistics reserves the right to suspend or terminate service to any customer who violates these Terms and Conditions, engages in fraudulent activity, or attempts to ship prohibited or unlawful items. In such cases, no refunds will be provided, and the Company may cooperate with relevant authorities as required by law. Customers may also choose to discontinue using our services at any time, but any outstanding balances owed to Naj Global Logistics must be paid in full before termination is complete.

9.Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Trelawny, Jamaica. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts located in Trelawny, Jamaica.

10.Amendments

Naj Global Logistics reserves the right to amend, revise, or update these Terms and Conditions at any time, with or without prior notice. Any changes will be posted on our official website or otherwise communicated to customers. Continued use of our services following such updates shall constitute acceptance of the revised Terms and Conditions.
